ANP Permanent Production Sharing Offer (OPP): five more qualified companies

The ANP Special Bidding Commission (CEL) qualified five more companies registered in the OPP to participate in the 1st Cycle, which will be held on 12/16/2022: BP Energy do Brasil Ltda, Ecopetrol Óleo e Gás do Brasil Ltda, Petronas do Brasil Ltda, Qatar Energy do Brasil Ltda and Total Energy EP do Brasil Ltda. Petrobras, Shell Brasil Petróleo Ltda and Chevron Brasil Óleo e Gás Ltda had already qualified, totaling eight companies so far, as other orders are yet to be analyzed by CEL.

In addition to registering with the OPP, in order to present offers in a cycle, companies must go through a qualification process, which determines the form of participation in the bidding. In the OPP, companies can be classified as an A+ operator and a non-operator (investor), as established in the tender notice.

Operator A+ is qualified to operate in blocks located in areas located within the pre-salt polygon and in strategic areas, as defined by the National Energy Policy Council (CNPE), for contracts signed under the production sharing regime. It must meet criteria such as experience in exploration and production activities, production volume in the last five years, investments in exploration in the last five years, aspects related to operational safety and the environment, in addition to obligatorily proving experience in exploration activities and/or production in shallow, deep or ultra-deep waters as an operator. The non-operating company is qualified to act only in a consortium and must prove, under the terms of the public notice, aspects such as legal, tax, labor and its activities in the sector.

The statement also informs that CEL has changed, from 10/25 to 11/1, the disclosure date of the blocks of the 1st Cycle of the Permanent Production Sharing Offer (OPP) that received expressions of interest from the companies and will be offered on the public session of 12/16/2022. The blocks are disclosed only after the completion of the qualification process for participation in the bidding and CEL is concluding the analysis of the documents received from the companies by 10/17.

The Permanent Production Sharing Offer (OPP)

The purpose of the Permanent Production Sharing Offer (OPP) system is to contract, under the production sharing regime, the exploration and production activities of oil and natural gas in blocks located in the Pre-Salt Polygon and in strategic areas, determined by the National Energy Policy Council (CNPE).

In this system, blocks are permanently available to interested regulated agents. The cycles begin at the request of the registered agents, through the submission to the ANP of a declaration of interest, accompanied by an offer guarantee, for one or more available blocks.
