The government is making progress in developing guidelines for Petrobras’ divestments in the refining sector. On Friday (26), the Ministry of Mines and Energy (MME) announced a new position by the National Petroleum Agency (ANP) on the subject. The guideline states that the refinery’s logistics infrastructure must be operated by companies other than the refiner. According to the folder, it will even be allowed that the companies that operate the logistics part and the refinery are constituted by the same economic group, that is, by logistics operators.
“It should be noted that the preference to be given to the owner of the facilities for handling their own products is guaranteed by ANP, through its rules, built with the broad participation of society, while also observing the regulation for third party access, aiming to promote maximum use of transport capacity by the available means, ”said the Ministry of Mines and Energy, in a note.
The MME also stated that this new positioning by the ANP is in line with the guidelines established by the National Energy Policy Council (CNPE), since it increases the number of agents recommended to operate the logistics assets of the refineries sold by Petrobrás. Council resolution 9/2019 determined that the sale of refineries and their respective logistics assets should occur at the same time. The text also established that this logistics infrastructure be sold to non-vertical economic groups, observing the regulation for third party access. Currently, eight Petrobras refineries are in the process of being sold.
