The ANP received 85 requests from 17 companies for additions to the local content clauses for contracts signed in seven rounds of exploratory areas and two auctions for areas with marginal accumulations. There are 68 requests for projects onshore and 17 offshore, especially the Libra project, which has already had partial waiver granted by the agency for the first FPSO project.
The new percentages were authorized by Resolution 1/2018 of the National Energy Policy Council (CNPE), published in the Federal Official Gazette on April 10, 2018. In opting for the addition, the company loses the right to waiver and adjustment. In addition, it must expressly waive any litigation that may have against the ANP due to fines already paid for noncompliance with the obligation of local content.
For onshore projects, the percentage will be 50% for exploration and development of production. In offshore projects, the new local content commitments are 18% for exploration, 25% for well construction, 40% for collection and disposal. For platforms the index is 40% in engineering, 40% in machinery and equipment and 40% in construction, integration and assembly.
