Who has been declared ineligible by the TCU?

The Plenary of the Court of Auditors of the Union (TCU) declared the ineligibility of MPE Montajes e Projetos Especiais (MPE). With the decision, the company is prohibited from contracting with the federal public service for three years. MPE had contracts with several areas of Petrobras, ranging from maintenance of platforms to construction and assembly in the downstream area.

The process that led to the ineligibility of  MPE established the individual responsibility of companies in frauds that occurred in bids for the construction of the Abreu e Lima Refinery (RNEST). According to the TCU, the losses due to the frauds in the bids organized by Petrobras in the RNEST amount to R $ 2.7 billion and involved five contracts. Also, according to the TCU, MPE is guilty of participating in a cartel.

Who has been declared ineligible?

 

Engevix

In July 2017, the TCU declared the company Engevix Engenharia ineligible due to fraud in the bidding process. As a result, the contractor is prohibited from bidding and signing contracts with the Federal Public Administration (APF) for a period of five years. The irregularities refer to the civil and electromechanical projects of the Thermonuclear Plant of Angra 3, in Rio de Janeiro.

 

Mendes Junior

Mendes Júnior was the first company to be declared ineligible by Operation Lava Jato in April 2016. As a result, the company was prohibited from making new contracts with the government for at least two years.

 

Skanska

In July 2016, the Federal Comptroller’s Office declared the construction company Skanska Brasil, of Swedish origin, to be ineligible due to irregularities investigated in Operation Lava Jato. According to the CGU, it was characterized that Skanska paid bribes to close a contract with Petrobras. With the declaration of unfairness, the company was prohibited from entering into new contracts with the public administration for at least two years.

 

Tomé Engenharia

In September 2017, the Ministry of Transparency and Comptroller General of the Union declared Tomé Engenharia ineligible to sign contracts with the government. The punishment prevents, for at least two years, the participation in new bids and the realization of new contracts in the municipal, state and federal spheres. In 2015, the Federal Comptroller’s Office (CGU) opened six administrative proceedings against companies investigated in Lava Jato, including Tomé Engenharia. According to the CGU, the process guaranteed the company the right to full defense.

 

Alumini Engineering

In March 2017, the Ministry of Transparency, Inspection and Controllership of the Union (CGU) declared Alumini Engenharia S / A ineligible to contract with the public administration. With the punishment, the infrastructure company is prohibited from bidding and signing new contracts with government agencies and entities for at least two years. The decision concluded a lawsuit filed because of irregularities investigated in Operation Lava Jato.

 

Iesa Oil & Gas

In September 2016, the Ministry of Transparency, Inspection and Control (MTFC) declared the ineligibility   of the company Iesa Óleo & Gás S.A.. The decision, signed by Minister Torquato Jardim, concludes the Administrative Procedure of Accountability (PAR) introduced by virtue of Operation Lava Jato. The sanction prohibits the company from participating in new bids and concluding new contracts with the Public Administration for at least two years.

 

Jaraguá Equipamentos Industriais

In December 2016, the Ministry of Transparency declared the inability of the company Jaraguá Equipamentos Industriais. The process used information shared by the Federal Court and others collected from various agencies, notably the Federal Public Ministry (MPF) and Petrobras. The decision prevents the company from participating in new bids or that is hired by the public administration at the federal, state and municipal levels.
