The definitive regulation of the waiver for contracts awarded since 2005 is going to follow the rules suggested by the ANP in December. At the time, the suggestion made by the agency was 50% local content for E & P in onshore projects, 18% in offshore blocks and three stages for offshore development, 25% for well construction, 40% for collection and 40% for PEUs in the Engineering, Machinery and Equipment segments and construction, integration and assembly.
The Steering Committee (CD) of Pedefor (Program to Encourage the Competitiveness of the Productive Chain, Development and Improvement of Suppliers of the Oil and Natural Gas Sector) unanimously approved the proposal submitted by the Technical Operational Committee (CTO), agreeing with the autonomy of the regulatory body to deliberate on the issue, establishing only the proviso that the percentages may not be lower than those established for contracts signed as from the 14th round.
With the decision taken at the meeting held on February 7, Pedefor is preparing a resolution, which will be published in the Official Gazette by the end of this month of February. Pedefor’s deliberation will have to be assessed and approved by CNPE in an extraordinary meeting to be scheduled for March.
Brasilia sources anticipate that the government is working to try to ensure the holding of the extraordinary meeting of the CNPE in the third week of March. By determination of the TCU, the ANP has until April to regulate the waiver issue for contracts signed between 2005 and 2015.
Discussions over waiver regulation have been going on for more than a year and also include the areas of onerous assignment and Libra. The original deadline for defining local content rules for assets purchased between 2005 and 2015 ended on December 13, but the agreement with TCU allowed for the extension until April.
In addition to the deliberation on the waiver regulation, the Steering Committee also approved that the local content of the permanent offer follow the same requirements established for the 14th and 15th rounds, and assets located in water depths of less than 15 m will not be free from compromise. The decision will have to be endorsed by CNPE at the March meeting.
