Rio de Janeiro, October 28, 2015 – Petróleo Brasileiro S.A. – Petrobras hereby responds to BM&FBovespa Official Letter 3229/2015-SAE requests clarification, as transcribed below:

“A news item published in Valor Econômico newspaper on October 27, 2015 states, among other matters, that, last week Petrobras had been sentenced to pay indemnification of R$566.67 million for the supply of piped gas services to the Fafen fertilizer plant in the Camaçari Petrochemical Complex (BA), a practice considered to be unconstitutional.

We have not identified this information in the documents submitted by this company through the Empresas.NET System. If the information has been provided, please state the document and the pages where it is located, as well as the date and time of submission.

It is worth noting that the Company must disclose periodic, eventual and other information of interest to the market through Empresas.NET, ensuring its wide and immediate dissemination and the equitable treatment of its investors and other market participants.

Clarification

On October 23, 2015, a judgment was issued in the Public-Interest Civil Action filed in 2006 by the Bahia State Public Energy, Transport and Communication Services Regulatory Agency – AGERBA related to the supply of natural gas to Petrobras’ fertilizer plant in Bahia (Fafen-BA).

The sentence imposed on Petrobras condemnation of R$ 566.67 million and obligation to sign a contract with BAHIAGÁS for the supply of gas to Fafen-BA.

Petrobras filed the appropriate legal measures and, on 10/27/2015, was granted an injunction suspending the Company’s obligation to pay this amount.
